Land ownership transfer
is one of the final steps in the land-buying process in Kenya. Transfer comes
late in the land acquisition process as other key steps must be finalized
before getting to the transfer stage.
Legal transfer can only
happen after finalizing the stamp duty payment stage. The stamp duty
declaration and pay-in-slip is one of the required documents in the ownership
transfer stage.
To initiate the transfer,
you (the buyer) and the seller will have to sign the requisite transfer forms
and submit the same to the land registry where the land you are buying is
located.
All the transfer
documents that must be submitted to the land registry are:
- A copy of the title deed
- The land search documents
- Clearance to transfer
certificate from the Land Control Board
- The transfer forms signed by the seller
- The valuation report
- The stamp duty declaration and pay-in-slip
- Land rent clearance certificate
- Land rates clearance certificate
- Certificate of clearance from the county
- A copy of your national ID (the buyer)
- A copy of your KRA PIN (the buyer)
- Three passport photos of the seller
- Three passport photos of yourself (the buyer)
There are fees to be paid
to the government during the ownership transfer phase. They are transfer
registration and new title deed fees. Proof of registration fee payment must
accompany the required documents.
After successful
registration, you will receive three documents. The documents are:
- An original Title Deed with your name on it.
- Registered Transfer Forms.
- The paying slip.
Once the transfer is
complete, the land has legally moved from the seller to you, the buyer. You
acquire all the rights of a landowner in Kenya.
